Software License Agreement

By using the Power Presence Web Engine (PPWE hereafter) you are agreeing to the terms of this license without limitation and in full. If you do not agree to these terms then you are not allowed to use the PPWE in any form.

The PPWE is not free software. Although the source code is written in PHP and you may have access to view and edit the code, you may not resell or distribute the code in any form. You may modify the source code for the purposes of updating and maintaining your web site.

During development of your site there may be modifications and customizations made to the PPWE. You are entitled to use and modify the PPWE for the purposes of your site. The PPWE source code is Copyright 2009-2011 Bob Lindquist and by purchasing a license you are not purchasing the intellectual property rights to the code. As the creator and owner of the code, Bob Lindquist reserves the right to use the PPWE for any purpose he chooses. This may include certain modifications or custom code created for the purpose of developing your web site.

The PPWE is licensed to you for one site only per license purchased. Using or attempting to reuse, resell or redistribute any part of the PPWE constitutes a breach of this agreement and will result in termination of this license, as well as civil and/or monetary damages.

The user will indemnify Bob Lindquist of any damages sustained before, during, or after the use of this product. Software is provided "as-is" and by using the software, the user gives consent to this stipulation. There is no warranty, implied or expressed.

The PPWE also does not imply any suitability for any specific hosting environment or purpose. Changes to your hosting environment, including updates to Apache, PHP. MySQL and other related functionality may break certain features.

The user is granted a non-trasnferrable, non-exclusive license to use the PPWE. This means that the user may not distribute, in any form, any version of the PPWE software to another party. Doing so will result in termination of the license agreement and any copies of the software must be destroyed. If you transfer the ownership of your company, and with it your web site, we may allow the license to transfer to the new owner. As stated before, the PPWE may be used for only one web site per license granted.

All information, data, text, software, music, sound, photographs, graphics, video, messages or any other materials whatsoever (collectively, "Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that the user is entirely responsible for all Content that he or she uploads, posts, emails or otherwise transmits via the PPWE or any Service. No user shall transmit Content or otherwise conduct or participate in any activities using the PPWE and/or any Service which are prohibited by law in applicable jurisdictions, including laws governing the encryption of software, the export of technology, the transmission of obscenity or the permissible uses of intellectual property.

This document may be updated at any time and will be available at this location on the boblindquist.com web site. This license takes effect immediately when posted and replaces any previous license granted.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

The intent of this license is to protect the intellectual property rights of Bob Lindquist and allow for the continued development and ownership of the PPWE by Bob Lindquist. It also intends for your reasonable use of this intellectual property for the purpose of displaying and maintaining your site.

You may not use this software to develop any competing content management system or web site platform.
